1. Service Description
Claim a Hex is a digital collectible platform where users can claim ownership of hex color codes. Each of the 16,777,216 possible hex colors (#000000 through #FFFFFF) can be claimed by one user at a time. Owners can display their name and a link on their color's page, and trade colors with other users.
2. User Accounts
You must create an account to claim or trade colors. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to keep your account details up to date.
3. Payments
Claiming a color costs $1 USD, processed through Stripe. All initial purchases are final and non-refundable. By completing a purchase, you agree that you are buying a digital listing on this platform - not the color itself.
4. Trading
Color trading uses a closed site credit system. Credits earned from selling colors can only be used to purchase other colors on the platform. There are no withdrawals, refunds, or cash-outs of site credit. A 1% platform fee is deducted from all trades.
5. Intellectual Property
Claiming a color on Claim a Hex grants you a listing on this platform. It does not grant you any intellectual property rights, trademark, or exclusive usage rights over the color itself. Colors are part of the public domain and cannot be owned in a legal sense. Your ownership is limited to your listing on this site.
6. Limitation of Liability
Claim a Hex is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the platform, including but not limited to loss of site credit, trading disputes, or service interruptions. Our total liability is limited to the amount you paid for your initial color claim.
7. Termination
We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or attempt to manipulate the platform. You may delete your account at any time, but site credit and color ownership will not be refunded.
8. Changes to Terms
We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms.
